In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), this Privacy Policy governs the personal-data processing that Hunkitu S.L. —hereinafter, Ama AI— carries out as Controller in relation to data collected through the website amaai.ai.

If you do not agree with the terms of this Policy, please do not access or use the Site. This Policy does not apply to any other service or activity of third parties linked from the Site.

Purposes of processing

Your personal data will be used for the general purpose of managing and administering the Site and, specifically, to:

  • Manage full access to and correct use of the Site.
  • Respond to information requests, demos, partnership proposals and any other communication sent through the contact form or published email addresses.
  • Contract Ama AI's services and open the corresponding customer record.
  • Send electronic communications about our services where there is a prior commercial relationship or express consent.

We will not process your personal data for any purpose other than those described, unless required by law or court order.

Retention period

Personal data will be retained from the moment the user grants consent until it is withdrawn, without prejudice to the right of erasure, in which case Ama AI will block the data while any legal obligations persist.

Legal basis

The legal basis for processing is the consent of the data subject, requested at the moment of:

  • Before processing your data.
  • Contracting or registering as a customer of Ama AI.
  • Requesting information, demos or suggestions, or contacting the company.

Information requests require the data subject to voluntarily provide the data necessary to handle them. Mandatory fields are marked with an asterisk (*). The data subject may freely refuse to provide data or later withdraw consent, although doing so may make it impossible to handle the request.

Likewise, we may process your data on the basis of Ama AI's legitimate interest to send electronic communications relating to our services where a prior contractual relationship exists, without prejudice to compliance with the rest of the obligations applicable to commercial electronic communications.

Recipients of transfers

As a general rule, Ama AI will not share your personal data with third parties unless legally required or expressly authorized by you.

To deliver the service we may rely on technology providers acting as data processors (cloud hosting, email infrastructure, productivity tools) located inside or outside the European Economic Area. In such cases, an adequate level of protection is ensured through the European Commission's Standard Contractual Clauses or other recognized safeguards.

Rights of data subjects

Anyone is entitled to confirmation as to whether Ama AI processes personal data concerning them. In particular, you can exercise the following rights:

  • Rectification: correct errors or modify inaccurate or incomplete data.
  • Erasure: request deletion when the data are no longer necessary.
  • Objection: object to processing or request its cessation, unless legitimate grounds or claim defence apply.
  • Objection to marketing communications: withdraw your consent to receive newsletters using the mechanism in the message itself, or by sending a letter with subject Unsubscribe to the address provided.
  • Restriction: in certain circumstances, restrict processing to mere storage for the defence of claims.
  • Portability: receive your data in a structured, commonly used, machine-readable format, or have it transmitted to another controller where technically feasible.
  • Not to be subject to automated individual decisions that produce legal effects or significantly affect you.
  • Withdraw consent at any time without prejudice to the lawfulness of processing based on prior consent.

Claims before the supervisory authority

Ama AI informs you of your right to lodge a complaint with the Spanish Data Protection Agency (AEPD) if you consider that the processing of your personal data infringes applicable regulations. You can contact the AEPD at www.aepd.es.

Security measures

Ama AI has adopted the technical and organizational measures necessary to prevent alteration, loss, unauthorized processing or access to personal data, taking into account the state of the art and the nature of the data processed. Nevertheless, the User should be aware that security measures on the Internet are not impregnable.
